1. Introduction and Acceptance of Terms
Welcome to PeachHaus Group ("Company," "we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of our website located at www.peachhausgroup.com (the "Site") and all related services, products, tools, and features provided by PeachHaus Group (collectively, the "Services").
By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services. Your continued use of the Services following the posting of any changes to these Terms constitutes acceptance of those changes.
2. Definitions
For the purposes of these Terms:
- "Company," "PeachHaus," "we," "our," or "us" refers to PeachHaus Group, a property management company headquartered in Marietta, Georgia.
- "Owner" refers to any property owner who engages PeachHaus for property management services.
- "Guest" refers to individuals renting properties on a short-term basis (less than 30 days).
- "Tenant" refers to individuals renting properties on a mid-term (1-6 months) or long-term (12+ months) basis.
- "Property" refers to any real estate managed under our STR, MTR, LTR, or Hybrid programs.
- "Services" includes all property management offerings, including our Hybrid Rental Strategy.
- "Hybrid Rental Strategy" refers to our proprietary approach of dynamically switching between short-term and mid-term rental strategies based on seasonality to maximize owner returns.
3. Description of Services
PeachHaus Group provides comprehensive property management services throughout Metro Atlanta, including:
- Short-Term Rental (STR) Management: Full-service management for vacation rentals and Airbnb properties, including guest screening, dynamic pricing, cleaning coordination, and platform marketing.
- Mid-Term Rental (MTR) Management: Furnished rental management for stays of 1-6 months, targeting corporate clients, traveling professionals, and insurance housing placements.
- Long-Term Rental (LTR) Management: Traditional lease management including tenant screening, lease administration, rent collection, and maintenance coordination.
- Hybrid Rental Strategy: Our exclusive approach that dynamically switches between STR and MTR strategies based on seasonality to maximize income and minimize vacancy.
- Co-Hosting Services: Partnership arrangements where owners retain their listings while PeachHaus provides operational support.
- Revenue Analysis and Income Reports: Property income projections and market analysis tools.
4. User Eligibility and Account Responsibilities
To use our Services, you must:
- Be at least 18 years of age and legally capable of entering into binding contracts.
- Provide accurate, current, and complete information during registration and maintain the accuracy of such information.
- Be responsible for maintaining the confidentiality of your account credentials.
- Accept responsibility for all activities that occur under your account.
- Comply with all applicable federal, state, and local laws, including Georgia landlord-tenant law (OCGA Title 44).
You agree to immediately notify us of any unauthorized use of your account or any other breach of security.
5. Property Owner Terms
If you are a property owner engaging our management services:
- Separate Management Agreement: These Terms are supplemented by a separate Property Management Agreement that governs the specific terms of our management relationship.
- Property Disclosure: You agree to provide accurate and complete information about your property, including any known defects, in accordance with Georgia Code § 44-7-3.
- Insurance Requirements: You are responsible for maintaining adequate property and liability insurance as specified in your Management Agreement.
- Compliance: You warrant that your property complies with all applicable building codes, zoning ordinances, and short-term rental regulations.
- Revenue Sharing: Management fees and revenue distribution are governed by your separate Management Agreement.
- Termination: Either party may terminate the management relationship in accordance with the terms specified in the Management Agreement.
6. Guest and Tenant Terms
If you are a guest or tenant:
- Separate Rental Agreement: Your stay or tenancy is governed by a separate rental or lease agreement that contains specific terms regarding your occupancy.
- Booking Policies: Reservation and booking terms, including cancellation policies, are specified in your rental agreement and on the applicable booking platform.
- House Rules: You agree to comply with all house rules and community guidelines applicable to your rental property.
- Security Deposits: Security deposit terms, including conditions for refund, are specified in your rental agreement.
- Damage Responsibility: You are responsible for any damage to the property beyond normal wear and tear caused during your stay or tenancy.
7. Intellectual Property Rights
All content on our Site, including but not limited to text, graphics, logos, images, photographs, videos, software, and the compilation thereof, is the property of PeachHaus Group or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our Site for personal, non-commercial purposes. You may not:
- Reproduce, distribute, modify, or create derivative works from our content without express written permission.
- Use our trademarks, service marks, or logos without prior written consent.
- Remove any copyright or proprietary notices from our materials.
By submitting content to us (including property photos, descriptions, or reviews), you grant PeachHaus Group a non-exclusive, royalty-free, worldwide license to use, reproduce, and distribute such content for marketing and operational purposes.
8. Prohibited Conduct
You agree not to engage in any of the following prohibited activities:
- Using our Services for any illegal purpose or in violation of any local, state, national, or international law.
- Discriminating against any person on the basis of race, color, religion, national origin, sex, familial status, disability, or any other protected class.
- Harassing, threatening, or abusing our employees, contractors, guests, tenants, or other users.
- Attempting to gain unauthorized access to our systems, networks, or data.
- Using automated systems, robots, or data mining tools to access our Site without permission.
- Providing false, misleading, or fraudulent information.
- Interfering with or disrupting our Services or the servers and networks connected thereto.
- Subletting or assigning your rental without express written permission.
9. Fair Housing Compliance
PeachHaus Group is committed to full compliance with the Federal Fair Housing Act (42 U.S.C. §§ 3601-3619), the Georgia Fair Housing Law (OCGA § 8-3-200 et seq.), and all applicable local fair housing ordinances.
We do not discriminate in the sale, rental, or financing of housing, or in the provision of brokerage services, on the basis of:
- Race or color
- Religion
- National origin
- Sex (including sexual orientation and gender identity)
- Familial status (including children under 18, pregnant women, and people securing custody of children)
- Disability (physical or mental)
- Any other class protected by applicable federal, state, or local law
All marketing, tenant screening, leasing decisions, and property management operations are conducted in strict compliance with fair housing requirements. If you believe you have experienced discrimination, you may file a complaint with the U.S. Department of Housing and Urban Development (HUD) at 1-800-669-9777 or the Georgia Commission on Equal Opportunity.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PEACHHAUS GROUP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of, or inability to access or use, our Services;
- Any conduct or content of any third party on our Services;
- Any content obtained from our Services;
- Unauthorized access, use, or alteration of your transmissions or content;
- Rental income or occupancy rates, which are estimates only and not guaranteed;
- Actions or omissions of guests, tenants, or property owners;
- Force majeure events, including natural disasters, pandemics, government actions, or other circumstances beyond our reasonable control.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT OF FEES YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that:
- Our Services will be uninterrupted, secure, or error-free;
- The results obtained from using our Services will be accurate or reliable;
- Third-party platforms (including Airbnb, VRBO, Furnished Finder, etc.) will remain available or operate without disruption;
- Any specific rental income, occupancy rate, or return on investment will be achieved.
All income projections, market analyses, and revenue estimates provided by PeachHaus are for informational purposes only and should not be construed as guarantees of actual results. Actual results may vary based on property type, location, seasonality, market conditions, and other factors.
12. Indemnification
You agree to defend, indemnify, and hold harmless PeachHaus Group, its officers, directors, employees, agents, licensors, and suppliers from and against any claims, actions, demands, liabilities, judgments, and settlements, including reasonable attorney's fees, arising from or related to:
- Your violation of these Terms;
- Your use of our Services;
- Any content or information you provide to us;
- Your violation of any law or the rights of any third party;
- Any dispute between you and any guest, tenant, or property owner;
- Any property-related claims, including personal injury or property damage occurring at a managed property.
13. Third-Party Services and Links
Our Services may contain links to third-party websites or services that are not owned or controlled by PeachHaus Group. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
This includes, but is not limited to:
- Booking platforms (Airbnb, VRBO, Booking.com, Furnished Finder, etc.)
- Payment processors
- Cleaning and maintenance service providers
- Background check and tenant screening services
- Insurance providers
Your use of third-party services is subject to the terms and privacy policies of those services. We encourage you to read the terms and privacy policies of any third-party services you access.
14. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and disclosure of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using our Services, you consent to:
- Our collection and use of your information as described in our Privacy Policy;
- Receiving communications from us regarding your account, bookings, and Services;
- Receiving marketing communications, from which you may opt out at any time.
15. Dispute Resolution
Good Faith Negotiation: Before initiating any formal dispute resolution process, you agree to first contact us at info@peachhausgroup.com to attempt to resolve any dispute informally. We will endeavor to resolve disputes within thirty (30) days of receiving notice.
Mediation: If informal resolution is unsuccessful, the parties agree to attempt in good faith to resolve any dispute through mediation administered by a mutually agreed-upon mediator in Cobb County, Georgia.
Binding Arbitration: If mediation is unsuccessful, any dispute arising out of or relating to these Terms shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Cobb County, Georgia.
Class Action Waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
Small Claims Exception: Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the court's jurisdiction.
16. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions.
For any matters not subject to arbitration, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Cobb County, Georgia. The Northern District of Georgia shall have jurisdiction over any federal matters.
17. Modifications to Terms
We reserve the right to modify these Terms at any time in our sole discretion. Changes will be effective immediately upon posting to our Site. We will indicate the date of the last revision at the top of these Terms.
For material changes that significantly affect your rights or obligations, we may provide additional notice, such as an email notification or a prominent announcement on our Site. Your continued use of our Services following any changes constitutes your acceptance of the revised Terms.
18. Termination
We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.
Upon termination, your right to use our Services will immediately cease. The following provisions shall survive termination: Intellectual Property Rights, Limitation of Liability, Disclaimer of Warranties, Indemnification, Dispute Resolution, and Governing Law.
19. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
20. Waiver
Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of PeachHaus Group.
21. Entire Agreement
These Terms, together with our Privacy Policy and any separate Management Agreement or Rental Agreement, constitute the entire agreement between you and PeachHaus Group regarding our Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.
